Terms of Service

1. Acceptance of Terms

By accessing or using the Token Name Service ("TNS") protocol, website, or any associated services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

These Terms constitute a legally binding agreement between you and TNS Protocol ("we," "us," or "our"). We reserve the right to modify these Terms at any time. Continued use of the Service after any modifications constitutes acceptance of the updated Terms.

2. Description of Service

TNS is a decentralized registry for unique token symbols on the Solana blockchain. The Service allows users to:

Register unique token symbols linked to Solana token mint addresses
Renew existing symbol registrations
Transfer symbol ownership
Look up and verify registered symbols

TNS operates as decentralized infrastructure. Once deployed, the smart contract operates autonomously according to its programmed rules.

3. Eligibility

You must be at least 18 years old and have the legal capacity to enter into these Terms. By using the Service, you represent and warrant that you meet these requirements.

You are responsible for ensuring that your use of the Service complies with all applicable laws and regulations in your jurisdiction.

4. Wallet and Account Responsibility

To use the Service, you must connect a compatible Solana wallet. You are solely responsible for:

Maintaining the security of your wallet and private keys
All activities that occur through your wallet
Any losses resulting from unauthorized access to your wallet

We do not have access to your private keys and cannot recover lost wallets or reverse transactions.

5. Symbol Registration

5.1 Registration Process

Symbol registration is conducted on a first-come, first-served basis. Registration requires payment in SOL according to the pricing schedule defined in the smart contract.

5.2 Registration Requirements

By registering a symbol, you represent and warrant that:

You have the right to register the symbol
The registration does not infringe on any third-party rights
You will not use the symbol for fraudulent or illegal purposes
The information you provide is accurate and complete

5.3 Expiration and Renewal

Symbol registrations are valid for the period specified at registration. Registrations must be renewed before expiration to maintain ownership. A grace period applies after expiration, after which the symbol becomes available for re-registration by anyone.

5.4 No Refunds

All registration and renewal payments are final and non-refundable. Blockchain transactions cannot be reversed once confirmed.

6. Prohibited Uses

You agree not to use the Service to:

Register symbols for fraudulent tokens or scams
Infringe on trademarks or intellectual property rights
Engage in market manipulation or deceptive practices
Violate any applicable laws or regulations
Interfere with or disrupt the Service or its infrastructure
Attempt to circumvent any security features or limitations

7. Intellectual Property

The TNS protocol, website, documentation, and related materials are protected by intellectual property laws. You may not copy, modify, or distribute our proprietary materials without permission.

Symbol registrations do not grant you any trademark rights. You are responsible for ensuring your symbol use does not infringe on existing trademarks.

8. Disclaimers

8.1 Service Provided "As Is"

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

8.2 Blockchain Risks

You acknowledge and accept the inherent risks of blockchain technology, including:

Network congestion and transaction delays
Smart contract vulnerabilities
Cryptocurrency price volatility
Regulatory uncertainty
Potential for permanent loss of assets

8.3 No Financial Advice

Nothing in the Service constitutes financial, investment, legal, or tax advice. You should consult appropriate professionals before making any decisions.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify, defend, and hold harmless TNS Protocol and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights
Your symbol registrations or token activities

11. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with applicable arbitration rules. You waive any right to participate in class action lawsuits or class-wide arbitration.

12. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TNS Protocol regarding the Service and supersede all prior agreements and understandings.
